This website is operated by STC, incorporated under the Companies Act with its registered office at Shamaru Trading Company, 57, East Sambandam Road, R.S.Puram, Coimbatore – 641002, Tamil Nadu

Please read these conditions carefully before using the Vaya.in website. By using the Vaya.in website, you signify your agreement to be bound by these conditions. This website and the contents of this website are operated by “STC (“Company”). In these terms, the words "You"/"User"/"I"/"we" Shall mean the end user accessing/using this website. The term “We”, “Us”, “Our” shall mean STC.

By mere use of the website, You shall be contracting with Shamaru Trading Corporation (STC) and these terms and conditions including the policies constitute your binding obligations with STC

In addition, when you use any current or future Vaya.in service , you will also be subject to the terms, guidelines and conditions applicable to that Vaya.in service. If these conditions of use are inconsistent with such terms, the terms will override the same.

These “conditions of use” constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Membership eligibility

Use of the website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the website. If you are a minor i.e. under the age of 18 years, you shall not register as a user of the website and shall not transact on or use the website. As a minor if you wish to use or transact on the website, such use or transaction may be made by your legal guardian or parents on the website. STC reserves the right to terminate your membership and/or refuse to provide you with access to the website if it is brought to STC’s notice or if it is discovered that you are under the age of 18 years.

Vaya website usage

The use of this website shall be in accordance with these terms. All rights of the website are reserved with STCand the website and no part of the website shall be reproduced, exploited, modified, stored in a retrieval system or transmitted in any form or by any means without the prior written consent of STC and the website. This website may not be used for the purpose of posting defamatory, abusive, offensive or criminal content.

When you use any of the services provided by us through the website, including but not limited to, (e.g. product reviews, seller reviews), you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this terms of use and shall be considered as part and parcel of this terms of use. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these terms of use, at any time without any prior written notice to you. It is your responsibility to review these terms of use periodically for updates/changes. This licence does not include any resale or commercial use of this website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another seller; or any use of data mining, robots, or similar data gathering and extraction tools.

This website or any portion of this website (including but not limited to any copyrighted material, trademarks, or other proprietary information) may not be reproduced, duplicated, copied, sold, resold, visited, distributed or otherwise exploited for any commercial purpose without express written consent of STC and / or its affiliates, as may be applicable.

You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Vaya.in and its affiliates without express written consent. You may not use any meta tags or any other “hidden text” utilising STC or its affiliates’ names or trademarks without the express written consent of STC acting on behalf of itself or its licensors . Any unauthorised use terminates the permission or license granted by STC herein.

You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about us or the brand name or domain name used by us including the terms STC, VAYA or otherwise engage in any conduct or action that might tarnish the image or reputation, of STC or sellers on platform or otherwise tarnish or dilute any STC’s trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the website or STC’s systems or networks, or any systems or networks connected to STC.

You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the home page of Vaya.in as long as the link does not portray STC, Vaya.in, their affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Vaya.in logo or other proprietary graphic or trademark as part of the link without express written consent of STC and / or its affiliates, as may be applicable.

STC shall have all the rights to take necessary action and claim damages that may occur due to your involvement/participation in any way on your own or through group/s of people, intentionally or unintentionally

ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. STC does not warrant that this site; information, content, materials, product (including software) or services included on or otherwise made available to you through the website; their servers; or electronic communication sent from us are free of viruses or other harmful components.

Nothing on the website constitutes, or is meant to constitute, advice of any kind.

You will be required to enter a valid phone number while placing an order on the website. By registering your phone number with us, you consent to be contacted by us or our partners via phone calls and/or SMS notifications, in case of any order or shipment or delivery related updates.

The user understands and expressly agrees that all access to and use of this website is at its sole risk.

The user will indemnify and hold harmless STC and the website from and against all harm, liabilities, injuries, losses, damages, costs and expenses incurred by STC and the website in connection with your access to or use of this website or any content.

The user agrees that it shall not take any action against STC and the website or any of its affiliates, officers, directors, employees, third party content providers, licensors, agents, or representatives in any connection with any matter relating to or arising out of your access to or use of this website.

Payment facility for product purchase

While availing any of the payment method/s available on the website, the company and the website, in any event, is not responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to the user due to any reason.

STC will accept Indian currency INR payments only. The website will not be responsible or assume any liability for payments made in other currencies.

STC and the website accept payments in the below given formats:

  5. Cash On Delivery (COD)

Vaya Cash Points

  1. Vaya Cash is the name of loyalty points as run on Vaya.in website, and is not valid for purchase of Vaya products anywhere else.
  2. Vaya Life has the right to define the earning value, redemption value and validity of Vaya Cash and it can change without notice.
  3. User cannot redeem Vaya Cash for money and any other kind, Vaya Cash can be only redeemed as discounts on Vaya.in
  4. If user cancel their order after using Vaya Cash, while the real money spent by the customer can be refunded, the Vaya Cash points used will be lost and will not be reallocated to the customer.
  5. Earned Vaya Cash for an order will be reversed in case of order cancellation or non-receipt of the order by the customer.
  6. In case of referral, Vaya Cash will be credited only after the referred friend receives their ordered Vaya product.
  7. Vaya has the rights to change the value of Vaya Cash.
  8. Vaya Cash points credited to customer accounts are eligible for redemption only after 30 days from the date of credit.
  9. I wish to join the VAYA WALLET Program and confirm my acceptance to the terms and conditions of the program provided to me at your stores and also available at www.vaya.in.
  10. I agree to recharge and to accept the refund if any through VAYA WALLET and utilise the same to purchase VAYA range of products through stores and www.vaya.in.
  11. I agree to receive updates, offers and other promotional communications through SMS, direct mail, email, whatsapp and other forms of communication.

Hautecase - 800 Vaya Cash Offer

  1. Offer valid until 30th April 2024.
  2. If Vaya Hautecase is purchased ≤25% offer, you can avail 800 Vaya Cash.
  3. If Vaya Hautecase is purchased using a coupon code, then you're not eligible for 800 Vaya Cash.

Gift Card

These terms and conditions apply to Vaya Gift Cards (“Gift Cards” or “Gift Card”) issued by Shamaru Trading Company (“STC”) on Vaya.in website. By purchasing or using a Gift Card, you are agreeing to and accept the following Terms and Conditions.

  1. Redemption
  2. Gift Cards may only be redeemed towards the purchase of eligible products on Vaya.in. Purchases are deducted from the redeemer’s Vaya Cash account. Any unused Vaya Cash will remain associated with the redeemer’s Vaya.in account and applied to purchases in order of earliest expiration date. If a purchase exceeds the redeemer’s Vaya Cash, the remaining amount must be paid by other online payment options available on Vaya.in.
  1. Limitations
  2. Gift Cards, including any­ unused Gift Card balances, expires 1 year from date of issue. Gift Cards may only be purchased in denominations as provided on Vaya.in website, or such other limits as STC may determine. Gift Cards cannot be used to purchase another gift card. No coupon discounts applicable on Gift Cards. Gift Cards cannot be reloaded, resold, transferred for value or redeemed for cash. Unused Gift Card balances associated with a Vaya.in account may not be transferred to another Vaya.in account. No interest will be payable by STC on any Gift Card or Gift Card balance. STC makes no representation or warranty that Vaya.in will always be accessible without interruption.
  1. Fraudulent
  2. STC is not responsible if a Gift Card is lost, stolen, destroyed or used without permission. STC does not guarantee to pay the purchaser of the Gift Card that the amount redeemed / used by fraudulently obtained for in case STC is not able to take payment from alternative forms from the customer / user who redeemed it. If the usage of Gift Card is identified as fraudulently obtained, STC will have the right to close customer accounts and take payment from alternative forms of payment if a fraudulently obtained Gift Card is redeemed and / or used to make purchases on Vaya.in.
  1. Governing Law and Jurisdiction
  2. These terms and conditions are governed by and construed in accordance with the laws of India. The customer agrees to submit to the exclusive jurisdiction of the courts of Chennai, in the state of Tamil Nadu. The customer agrees to indemnify and hold harmless STC for all claims brought by a third party against STC or Vaya.in or its affiliates arising out of or in connection with a breach of any of these terms and conditions.
  1. Limitations of Liability
  2. STC DOES NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED WITH RESPECT TO THE GIFTCARDS, INCLUDING WITHOUT LIMITATION. ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL. YOUR SOLE REMEDY WILL BE THE REPLACEMENT OF SUCH GIFT CARD. IF APPLICABLE LAW DOES NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
  1. General Terms
  2. The STC Terms and Conditions on Vaya.in apply to Gift Cards. STC reserves the right to change these Gift Cards terms and conditions from time to time in its discretion and without prior notice to you. All terms and conditions are applicable to the extent permitted by law.

Delivery Details

We have partnered with courier service/s to deliver products to customers. If the website and STC receives order after 2:00 pm, then its next day will be considered as the first day of delivery / shipping duration. Our deliver service partners work on all days of the week but we do not guarantee delivery on Sunday and on any holidays (including national holidays).

Our delivery service providers will make two attempts to deliver your order to you. Further to which the order will be returned back to us. In this situation we can refund your order amount but we will be charging ₹400 restocking fee will be deducted per product from your refund amount.

Sometimes, delivery may take longer due to

  1. bad weather
  2. flight delays
  3. political disruptions
  4. other unforeseen circumstances

In such cases, the delivery might get delayed (beyond 10 working days can be as 10-15 or 15-20 working days). The company and the website will not be able to compensate for any mental agony caused due to delay in delivery

We regret to inform you that currently we do not have international shipping through the website. We request you to contact us at customer.care@vaya.in, in case of any bulk orders and we can possibly make some special arrangements for you.

Responsibility on post delivery

Once the user receives the ordered products, the user will be responsible for title and risk of loss for the ordered products.

Returns & Refund Policy

We have a 5 Days return policy (from the day of delivery) subject to the following issues only:

  1. If there is any manufacturing defect which is hampering the optimal intended use for our products, OR
  2. If you may have received a product which did not match the specifications mentioned on the website at the time of placing your order for example the wrong colour or size OR
  3. If you have received product in a damaged condition; in this case you need to inform us about the condition within 24 hours of receipt of your order by you.

You have to contact the customer care centre with your order details to address the issue and we’ll arrange the pickup of your shipment at no extra cost to you.

Please ensure that product is in unused and original condition which includes all price tags, labels, accessories, original packing and the invoice along with the product. And in the case of any manufacturing defects we require the original packing, accessories and invoice even though the product may have been used by you. Once we have the received the returned shipment and your return has been processed, your refund amount will be processed immediately. However, kindly note that some banks take from 7 days to 21 days to complete the refund process.

Following products shall not be eligible for return or replacement:

  1. Damages due to misuse of product;
  2. Incidental damage due to malfunctioning of product;
  3. Any consumable item which has been used/installed;
  4. Products with tampered or missing serial/UPC numbers;
  5. Digital products/services
  6. Any damage/defect which are not covered under the manufacturer’s warranty
  7. Any product that is returned without all original packaging and accessories, including the box, manufacturer’s packaging if any, and all other items originally included with the product/s delivered;
  8. Personalised products with laser etching will strictly not be considered for Returns or any Refunds.

Cancellation of orders by the user, website and the company

In case of cancellation after a confirmed order is placed, an amount of ₹400 will be charged per product cancelled.

For any fraudulent activity, STC and the website reserves the right to cancel all past, pending and future orders without any liability. STC and the website also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of product on website, stock unavailability, bulk orders and incomplete information or address provided by the user. The user’s internet protocol (IP) will be logged when placing an order. This is for reasons of fraud protection. Account for the customers falling in fraudulent or loss to business category may be blocked.

Governing Law

The use of this website and the services of this website and any dispute arising out of such use are subject to the laws of India, having jurisdiction before the competent courts of Chennai in the State of Tamil Nadu in India.

Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our website, policies, and these conditions of use at any time. You will be subject to the policies and conditions of use in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
